General Exclusion of Liability
Whilst Rough As Guts will take all reasonable steps to provide a safe and enjoyable experience, the company accepts no liability for any loss or personal injury. All Rough As Guts tour guests accept that tours include activities such as hiking and swimming and that all guests participate at their own risk. The company’s insurance provider does not cover liability in respect of personal injury to any person where such personal injury occurs directly or indirectly out of, or caused by, or in connection with any adventure activity.
Some tours may include optional tour activities, e.g. helicopter flights and boat cruises which are not under the management or control of Rough As Guts. Whilst all reasonable care is taken in selecting the respective operators, Rough As Guts cannot accept responsibility for outside operators’ conduct, or the conduct of or any resulting consequences of their respective employees.
Licensed & Roadworthy Vehicle
Each tour participant is solely responsible for their vehicle. Registration, insurances and good working mechanical condition of the vehicle is the responsibility of the driver.
All individual insurances are the responsibility of each individual tour participant. As a minimum, we require that every vehicle has third party liability insurance, and that each person has ambulance cover. We recommend having comprehensive vehicle insurance with roadside assist and purchasing travel insurance where possible.
The tour operator may voluntarily, or by operation of law, assign or otherwise transfer its obligations without the prior written consent of the client.
In plain English: This is not so we can sub-contract out the tours to someone else, this is just in case we need to change our business structure. I.e. the accountant calls and says something along the lines of “now that you’ve just gotten married, your taxes are changing, let’s consider…”.
